TERMS AND CONDITIONS

1. ABOUT THESE TERMS
These Terms and Conditions ("Terms") apply to inquiries, quotations, bookings, payments, yacht charter arrangements, customer support, and related services provided by Phangan Yachts Co., Ltd. ("Phangan Yachts", "we", "us", or "our").

By making an inquiry, requesting a quotation, confirming a booking, making payment, boarding a vessel, or using our services, you agree to these Terms.
2. OUR ROLE AS A YACHT CHARTER AGENCY
Phangan Yachts provides yacht charter agency, booking coordination, customer support, marketing, consulting and related services.
Unless expressly stated otherwise in writing, Phangan Yachts is not the vessel owner, vessel operator, captain, crew employer, marine carrier, transport operator, tour operator, insurer, hotel, transfer company, catering company, or provider of onboard operational services.
The actual vessel operation, navigation, route execution, safety management, crew, vessel condition, maintenance, seaworthiness, licenses, permits, insurance, and compliance with marine and tourism laws are the responsibility of the relevant independent vessel owner, licensed operator, captain, crew, or service provider.
Phangan Yachts acts as an intermediary between the customer and the relevant vessel operator or service provider. We may collect payments, coordinate booking details, communicate with the customer and operator, and support service quality, but we do not control the vessel, captain, crew, sea conditions, weather, navigation decisions, or operational safety decisions.
3. SERVICES WE MAY ARRANGE
We may arrange or coordinate:
- private yacht and catamaran charters;
- speedboat transfers and private marine transfers;
- day charters, sunset charters, half-day charters, full-day charters and event charters;
- bareboat charter inquiries where applicable;
- catering, drinks, decorations, photography, watersports, transfers and other extras;
- customer support, itinerary planning and booking coordination.
The exact services included in each booking will be stated in the quotation, invoice, booking confirmation, itinerary, or written communication.
4. QUOTATIONS AND AVAILABILITY
All quotations are subject to availability and operator confirmation.
A quotation does not create a confirmed booking until:
- the customer accepts the quotation;
- the required deposit or full payment is received by Phangan Yachts or as otherwise instructed in writing;
- the vessel operator accepts and confirms the booking;
- Phangan Yachts issues written booking confirmation.
Prices, vessel availability, routes, inclusions, exclusions, extras and conditions may change before booking confirmation.
5. BOOKING CONFIRMATION
A booking is confirmed only when Phangan Yachts confirms it in writing by WhatsApp, email, invoice, receipt, or other written communication.
The customer is responsible for checking all booking details before confirmation, including:
- date and time;
- vessel;
- route or destination;
- number of guests;
- boarding location;
- duration;
- inclusions and exclusions;
- price, deposit and balance;
- cancellation terms;
- special requests and extras.
Any change requested after confirmation is subject to availability, operator approval and possible additional charges.
6. PRICES, TAXES AND PAYMENT
Prices may be quoted in Thai Baht or another currency, depending on the case. Unless stated otherwise, payment in Thai Baht is the primary settlement method.
Prices may include or exclude taxes, VAT, government fees, bank fees, payment processing fees, transfer fees, park fees, marina fees, fuel surcharges, delivery fees, overtime, corkage, BYO fees, or other extras. The quotation or invoice will specify the commercial terms applicable to the booking.
Payment methods may include bank transfer, Thai QR transfer, cash payment, international transfer, approved digital payment method, or other payment method accepted by Phangan Yachts.
The customer is responsible for payment fees, bank charges, exchange differences, failed payments, reversed payments, chargebacks and incomplete transfers unless agreed otherwise in writing.
7. DEPOSIT AND BALANCE
A deposit may be required to secure a booking. The balance must be paid by the deadline stated in the quotation, invoice or booking confirmation.
If the balance is not paid on time, the booking may be cancelled, released, rescheduled, or treated as a customer cancellation, depending on the circumstances and operator policy.
Phangan Yachts may refuse boarding, withhold confirmation or suspend services until payment is received in full.
8. SECURITY DEPOSIT, DAMAGES AND EXTRAS
Some bookings may require a refundable security deposit. The amount and conditions will be stated before confirmation where applicable.
The customer is responsible for damage, loss, breakage, excessive cleaning, toilet misuse, equipment loss, late return, unauthorized activities, or other costs caused by the customer or guests.
The customer is also responsible for approved extras and additional charges, including but not limited to:
- additional guests;
- extra charter time;
- route extensions;
- premium catering or drinks;
- birthday or event decorations;
- photography or drone services;
- private transfers;
- watersports or equipment;
- corkage, BYO or service fees;
- national park or island fees;
- marina or pier fees;
- special delivery or relocation costs.
9. CUSTOMER CANCELLATION
Cancellation terms vary depending on the vessel, operator, season, route, payment status and specific booking conditions.
The cancellation policy stated in the quotation, invoice, booking confirmation, or operator-specific terms will apply to that booking. If no specific cancellation policy is stated, the following general principles apply:
- deposits may be non-refundable after booking confirmation;
- customer cancellations close to the charter date may result in partial or full loss of payment;
- no-show, late arrival causing the charter to be missed, or refusal to board without valid safety reason may be treated as customer cancellation;
- refunds, if approved, may be reduced by bank fees, payment processing fees, third-party costs, operator charges, and non-recoverable expenses.
Any refund must be approved in writing by Phangan Yachts and/or the relevant operator.
10. WEATHER, SAFETY AND OPERATOR CANCELLATION
Marine activities are weather-dependent. The captain and/or vessel operator has final authority over operational safety, route execution, departure, return, speed, anchorage, alternative routes, delay, postponement or cancellation.
A charter may be changed, delayed, rescheduled or cancelled due to:
- unsafe weather;
- high wind, wave or sea conditions;
- official warnings or restrictions;
- Marine Department instructions;
- mechanical issue;
- safety concern;
- crew illness;
- force majeure;
- operational reason outside Phangan Yachts' control.
Where the operator or captain cancels for safety or operational reasons, Phangan Yachts will normally assist the customer to seek one or more of the following options, depending on operator policy and availability:
- rescheduling;
- alternative vessel;
- alternative route;
- credit for future use;
- partial refund;
- full refund.
Phangan Yachts does not guarantee a refund unless the refund is agreed by the relevant operator or required by applicable law.
11. ROUTE, ITINERARY AND TIMING CHANGES
Routes and itineraries are indicative unless expressly guaranteed in writing. Actual route, anchorage, beach access, snorkeling point, island stop, cruising speed and timing may change due to weather, sea state, tide, safety, traffic, government restrictions, vessel condition, guest safety, or captain's decision.
The customer is not entitled to compensation solely because the route or itinerary is changed for safety, weather, operational or regulatory reasons.
Late arrival by the customer may reduce charter time. Extra time is subject to availability and additional charges.
12. CUSTOMER AND GUEST RESPONSIBILITIES
The customer is responsible for themselves and all guests in their group.
The customer and guests must:
- arrive on time;
- follow captain and crew instructions;
- comply with safety briefings;
- wear life jackets when instructed;
- supervise children at all times;
- avoid unsafe, illegal, disrespectful, aggressive or disruptive behavior;
- avoid bringing illegal substances or prohibited items on board;
- respect the vessel, crew, marine environment and local regulations;
- inform us in advance about mobility limitations, serious allergies, relevant medical conditions, pregnancy, or safety-related requirements;
- provide accurate information about guest count, age of children and special needs;
- comply with national park, marine, island, pier and local rules.
The captain or operator may refuse boarding, remove a guest, return to port, change route, or terminate the charter if customer or guest behavior creates safety, legal, reputational or operational risk. In such cases, refunds may be refused.
13. ALCOHOL, FOOD AND BYO
Alcohol, food and BYO arrangements depend on the vessel and operator policy.
The customer must confirm in advance whether bringing own food, alcohol or drinks is allowed. Corkage, butler, cleaning, catering or service fees may apply.
The captain or crew may restrict alcohol consumption for safety reasons. Illegal drugs are strictly prohibited.
14. CHILDREN, ELDERLY GUESTS AND SPECIAL NEEDS
Children, elderly guests, pregnant guests, guests with mobility limitations, and guests with medical conditions may require additional safety consideration.
The customer must inform Phangan Yachts before confirmation if any guest requires special assistance. The operator may decline, modify or restrict participation if the service is not suitable or safe.
15. INSURANCE
Vessel insurance, passenger insurance and liability insurance depend on the relevant vessel owner or operator, applicable Thai law, vessel type, route and operator policy.
Phangan Yachts does not provide personal travel insurance, health insurance, accident insurance or property insurance to customers unless expressly stated in writing.
Customers are advised to maintain appropriate travel, medical, cancellation and personal accident insurance.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Phangan Yachts is not liable for:
- acts, omissions, negligence or default of independent vessel owners, operators, captains, crews, drivers, transfer providers, catering providers, hotels, villas, photographers, watersport providers or other third-party service providers;
- weather, sea state, official restrictions, force majeure, mechanical issues, route changes, delays, cancellations, missed connections or loss of enjoyment;
- injury, illness, death, loss, damage, theft, delay or expense caused by factors outside our reasonable control;
- indirect, consequential, special, punitive or loss-of-profit damages;
- inaccurate information provided by the customer, operator or third party;
- failure of payment systems, messaging platforms, internet services or third-party technology.
Where Phangan Yachts is legally liable, our total liability shall be limited to the amount of agency service fee or commission actually retained by Phangan Yachts for the relevant booking, unless a higher amount is required by mandatory law.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
17. THIRD-PARTY SERVICE PROVIDERS
Third-party service providers may have their own terms, conditions, waivers, safety rules, cancellation policies and liability limitations. By using such services, the customer agrees to comply with the applicable third-party terms.
If there is a conflict between these Terms and mandatory operator safety instructions, the operator's safety instructions and captain's decisions prevail for onboard and marine operations.
18. PHOTOS, VIDEO AND MARKETING CONTENT
We may ask for permission to use photos, videos, feedback or reviews for marketing. We will not intentionally use identifiable customer images for marketing without consent, unless the material has already been publicly posted by the customer and may lawfully be shared.
The customer must not use drone, professional photography, commercial filming or promotional content creation during a charter without prior approval where required by the operator, authorities or Phangan Yachts.
19. PRIVACY AND PERSONAL DATA
Personal data is handled in accordance with our Privacy Policy.
The customer agrees that necessary booking and guest information may be shared with vessel operators, captains, crews, transfer providers, catering providers, payment providers, authorities, insurers and other parties where required for booking, service delivery, safety, payment, compliance or legal purposes.
20. FORCE MAJEURE
Phangan Yachts is not liable for failure or delay caused by events outside our reasonable control, including but not limited to:
- severe weather;
- unsafe sea conditions;
- natural disasters;
- fire, flood, epidemic or public health emergency;
- war, terrorism, civil unrest or government action;
- port, pier, marine or island closure;
- official restrictions or warnings;
- labor disruption;
- transport disruption;
- fuel shortage;
- mechanical failure not caused by Phangan Yachts;
- failure of third-party suppliers, operators, payment systems, communication systems or infrastructure.
21. COMPLAINTS AND SERVICE ISSUES
Customers should notify Phangan Yachts as soon as possible about any service issue, preferably during the charter or immediately after the issue occurs, so that we can try to assist.
Complaints submitted after the charter will be reviewed based on available evidence, operator response, photos, messages, crew statements and booking records.
Phangan Yachts may help mediate between the customer and operator but does not guarantee compensation, refund or outcome unless agreed in writing.
22. PROHIBITED USE
The customer must not use our services for illegal activities, unsafe activities, unauthorized commercial activity, unlawful transport, drug use, harassment, violence, prostitution, human trafficking, wildlife trafficking, environmental harm, or any activity that may breach Thai law, marine regulations, tourism regulations, operator rules or public order.
We may refuse or cancel service if we reasonably believe the booking creates legal, safety, reputational, financial or operational risk.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time. The latest version will be published on our website. The version applicable to a confirmed booking is normally the version in effect at the time of booking confirmation, unless mandatory law requires otherwise.
24. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of Thailand.
The parties will first try to resolve disputes amicably through good-faith communication. If the dispute cannot be resolved amicably, it shall be submitted to the competent courts of Thailand, unless another dispute resolution mechanism is expressly agreed in writing.
